Perhaps I can offer some assistance. I currently have or share something
like 17 US and PTO patents.
We normally file through a patent law firm to try to frame the language and
claims for maximum protection and then make application. This is my
experience.
1) Filling normally take 3 to 6 months to frame the claims but
we have filed in as little as three weeks.
2) After submission of the application, the Patent Office will
review and issue a Filing, after this is received back the patent is then
under review and can be marked Patent Pending. A Patent Application is
published in 18months unless a quick review is requested.
3) Review can take anywhere from 12 to 30 months depending upon
the wording of the claims. It is common for the Patent Examiner to ask for
modification or deletion of claims that they feel are not applicable before
accepting or rejecting the application.
4) If the review is successful a Patent is issued, our current
costs for the process ranges from 20KUSD to 90KUSD with an average of
46KUSD. Quickest we have received a patent is 14 months, longest is 4 years.
5) Patents only have value if you can defend them, we have
brought two Patent Infringement cases before the courts. Both cost over
1.0MUSD dollars, One case we won and one we lost. Both took more than 5
years to settle. Total awarded damages from the one we lost was less than
the legal fees.
There are simple ways to protect an idea, go to the UP Patent Office web
site and look at Filing On Line
(http://www.uspto.gov/patents/process/file/efs/index.jsp). Also take a look
at the USPTO FAQ (http://www.uspto.gov/faq/patents.jsp#a1). Hope this helps.
