The enforcability of a shrink-wrap license has I believe never been
tested - although in the handfull of UCITA states it would be valid.

What is probably of more concern is the dreaded DMCA's 'circumvention'
provision that prohibits distributing a tool for getting around a
technical measure which protects a copyrighted work - for any purpose,
even a legally protected one like restoring access to a broken/damaged
system. Probably unconstitutional, but no one has seen fit to sink
the bucks into fighting its major backer - the recording industry.
