UPGRADED "old" version can not be sold - the original licensed copy has merely been upgraded - its like adding CNC to a mill, once you're done installing the CNC, you can't sell the mill.

What has been suggested is buying older copies from the many companies that have gone out of business or cut head count. There have been court rulings that say the right to do this can not be restricted - book companies argued they should be able to restrict a book to the original purchaser and make selling (specific) used books illegal.

The issue with buying surplus software is much the same as buying surplus equipment - are you getting all the "parts" - can you document the original purchase of the licensed copy of the software.
