ahh, that's always an interesting question...
since i am a techie, i think i can swing at this.
IF att thought linus "stole" code, freebsd, Redhat, suse, and any
number of other "distributions" would be sued back into minimum wage
jobs.
linux, after the GNU, may have bits of CODE used ***ON**** unix
machines, but not IN any kernel. These would have been added to the
individual coders that contributed to the code.
BUT...
that level of code (scripts, really) is just about as propriatary (sp)
as ASCI or ANSI codes... or adding red to yellow to make orange...
it's not kernel, it's scripts...
this is a very subtle thing.. and it's hard to explain without about 2
hours of typing...
(way way over simplified)
it boils down to , once you install the KERNEL (linux, windows, xenix)
and have the machine running, you change it with SCRIPTS
